Website Terms of Use
Effective date: August 25, 2026
These Website Terms of Use ("Terms") govern access to and use of theproofandpour.com and related online content provided by Proof & Pour LLC ("Proof & Pour," "we," "us" or "our"). By using the website, you agree to these Terms. If you do not agree, do not use the website.
1. Website Information
The website provides general information about Proof & Pour's services, packages, starting prices and service area. Content may be updated without notice. We do not guarantee that every service, date, package, enhancement, staff member or piece of equipment shown will be available for every event.
2. No Alcohol Sales
Proof & Pour does not sell or supply alcoholic beverages through the website or under its dry-hire service model. Clients purchase, pay for and own all alcoholic beverages. Any public, ticketed, cash-bar or alcohol-sale arrangement requires a properly licensed party to control purchasing, permits and sales.
3. Quotes and Bookings
Submitting a form, requesting a quote, exchanging messages or receiving a preliminary estimate does not reserve an event date or create a service contract. A booking is governed by a separate written service agreement. Unless that agreement states otherwise, the date is reserved only after Proof & Pour receives the signed agreement and the 50% nonrefundable retainer.
4. Pricing
Website prices are starting prices and may change. Final pricing depends on guest count, duration, staffing, location, menu complexity, supplies, rentals, venue requirements, travel, taxes, permits, parking, holidays, late-night service and approved changes. If website language conflicts with a signed service agreement, the signed agreement controls.
5. Event and Alcohol Responsibilities
The client, venue, caterer, organizer or other properly licensed party is responsible for purchasing alcohol and obtaining required permissions, permits or licenses. Proof & Pour may verify age and refuse or stop service to minors, visibly intoxicated guests, aggressive guests, unlawful activity or unsafe conditions. Additional responsibilities are stated in the service agreement.
6. Acceptable Website Use
You may use the website only for lawful purposes. You may not interfere with site operation, attempt unauthorized access, introduce malicious code, scrape or harvest information, impersonate another person, submit false inquiries, infringe rights or use website content to create a competing copy.
7. Intellectual Property
The Proof & Pour name, logo, website design, photographs, cocktail names, original copy, graphics and other content are owned by or licensed to Proof & Pour and are protected by applicable intellectual-property laws. You may view the website for personal, noncommercial purposes. No other use is permitted without prior written authorization.
8. User Submissions
If you submit reviews, photographs, ideas, feedback or other content, you represent that you have the right to provide it. Proof & Pour will not use identifiable client or guest images for marketing without the permission required by the applicable agreement or release. Do not submit confidential, unlawful or infringing material.
9. Third-Party Links
Links to social media, payment processors, retailers, venues or other third parties are provided for convenience. Proof & Pour does not control and is not responsible for third-party content, availability, security, products, services or privacy practices.
10. Disclaimer
The website is provided on an as-is and as-available basis to the fullest extent permitted by law. Proof & Pour disclaims warranties regarding uninterrupted operation, error-free content, availability, accuracy and fitness for a particular purpose. Nothing on the website is legal, licensing, tax, medical or insurance advice.
11. Limitation of Liability
To the fullest extent permitted by law, Proof & Pour will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use the website. Any liability relating to contracted event services is governed by the signed service agreement and applicable law.
12. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold Proof & Pour and its owners, personnel and service providers harmless from claims, losses, liabilities and expenses arising from your unlawful website use, violation of these Terms or infringement of another party's rights.
13. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute will be handled in a court of competent jurisdiction as determined under applicable law, unless a written agreement between the parties provides a different dispute process.
14. Changes
We may update these Terms by posting a revised version with a new effective date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
15. Severability and No Waiver
If any provision is held unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver of the right to enforce it later.
16. Contact
